These Terms of Service ("Terms") are a legal agreement between Bright on Analytics dbs Trampolin.ai ("Trampolin.ai," "we," "us," or "our") and the person or entity ("you," "your," or "Customer") who accesses our websites (including trampolin.ai and insights.trampolin.ai) or uses our products, services, applications, or content (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, and Refund Policy (collectively, the "Agreement"). If you do not agree, do not use the Services.
We may update these Terms from time to time. Changes take effect upon posting. Your continued use of the Services constitutes acceptance of updated Terms.
You represent and warrant that you are at least 18 years old, can form a binding contract, and—if acting for an entity—have authority to bind that entity.
You will comply with all applicable laws and will not: use the Services for unlawful, harmful, infringing, or abusive purposes; exploit minors; incite violence or terrorism; send spam; upload malware or resource-draining code; attempt unauthorized access; scrape or harvest except as expressly permitted; reverse engineer; or infringe third-party rights. We may monitor compliance and suspend/terminate for violations.
You are responsible for your credentials and all activity under your account. Notify us promptly of any unauthorized use or security incident.
Except for rights expressly granted, Trampolin.ai and its licensors retain all right, title, and interest in and to the Services and Trampolin.ai Content. Subject to your compliance and timely payment, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal business purposes during the applicable term.
You own your Customer Content. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and use Customer Content to provide and improve the Services. You represent you have necessary rights and that your Content and use are lawful. We may use Feedback without restriction.
The Services may interoperate with or link to third-party services (e.g., analytics, payment processors, automation tools). We do not control and are not responsible for third-party services; your use is subject to their terms.
We use commercially reasonable efforts to provide the Services on a 24/7 basis, subject to maintenance and events beyond reasonable control. We may modify or discontinue features. Beta features are provided as-is, may be unstable, and may be withdrawn at any time.
You agree to pay all fees specified in your order form or on our then-current pricing pages. We may update or modify our pricing, fee structure, and/or the number of credits deducted for any service, feature, or transaction at any point in time at our sole discretion. Any such changes will apply only prospectively from their effective date and will not be applied retroactively. Unless expressly stated otherwise, all fees are non-refundable (see Refund Policy). You authorize us and our payment processor(s) to charge your designated payment method for all applicable fees. You are solely responsible for all applicable taxes, duties, and similar governmental charges, excluding our income taxes. Continued access to or use of the Services after a change becomes effective constitutes your acceptance of the updated pricing and/or credit terms.
Our Privacy Policy and Cookie Policy explain our data practices. You are responsible for any notices/consents you owe to your end-users. We implement technical and organizational measures, but no method is 100% secure. The Services may involve international data transfers with appropriate safeguards as required by law.
All data, metrics, estimates, insights, analyses, inferences, predictions, and other outputs provided by Bright on analytics dba Trampolin.ai or Insights (collectively, "Data") are provided "as is," "as available," and "with all faults." We make no representation, warranty, or guarantee that the Data (i) is complete, correct, current, or free of errors/omissions, or (ii) will be updated in real time or within any particular time frame. The Data is informational only and not professional advice. You are solely responsible for how you use the Data and for independently verifying any Data material to your decisions.
You acknowledge the Data may be inaccurate, incomplete, delayed, unavailable, or inconsistent due to factors outside our reasonable control, including (without limitation):
We have no duty to monitor, audit, update, supplement, or correct the Data on any schedule. We may apply fixes, backfills, re-processing, or re-indexing at our discretion without commitment to any timeline or completeness.
You agree (i) not to rely on the Data as the sole basis for decisions; (ii) to implement reasonable validation/QA/contingency measures; and (iii) that you—not Bright on Analytics Ltd dba Trampolin.ai or Insights—are responsible for compliance obligations (including advertising, consumer-protection, privacy, and competition laws) arising from your use of the Data.
To the maximum extent permitted by law, Bright on Analytics Ltd dba Trampolin.ai or Insights shall have no liability of any kind (contract, tort—including negligence—strict liability, or otherwise) for any inaccuracy, incompleteness, delay, unavailability, interruption, or other defect in the Data or for any decision or action you take (or fail to take) in reliance on the Data, including without limitation for lost profits, revenue, data, goodwill, or any indirect, incidental, special, consequential, exemplary, or punitive damages, even if advised of the possibility of such damages.
If Bright on Analytics Ltd dba Trampolin.ai or Insights is found to have a remedial obligation with respect to the Data, your sole and exclusive remedies shall be, at our option and sole discretion to approve: (1) re-performance or re-provision of access; (2) a service credit or term extension proportionate to the material impact; or (3) termination of the affected order with a pro-rata credit for the unused portion of the affected term (only if a credit is mandated by applicable law). No refunds are due except where non-waivable by law or expressly agreed in writing by us. For more information, please see our Refund Policy.
Nothing in this Section excludes or limits liability to the extent such exclusion/limitation is prohibited by law (e.g., liability for fraud or willful misconduct). This Section supplements and does not reduce any broader warranty disclaimers or liability limitations in these Terms; in case of conflict, the more protective limitation/disclaimer applies to the extent permitted by law.
"Data" includes any raw records, aggregates, estimates, reach/performance metrics, analytics, dashboards, reports, exports, APIs, models, model outputs, predictions, and other deliverables or insights furnished by or through the Services, whether sourced directly, indirectly, or derived.
You will not use the Services in violation of applicable export control or sanctions laws and represent you are not a prohibited party.
The Services and all Trampolin.ai content are provided "as is," "as available," and "with all faults." To the maximum extent permitted by law, we disclaim all warranties (express, implied, or statutory), including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation or that outputs will meet your requirements or be accurate or reliable. (See also Section 11.)
To the maximum extent permitted by law: (a) neither Trampolin.ai nor its affiliates, officers, directors, employees, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption, even if advised of the possibility; and (b) our total aggregate liability for all claims arising out of or relating to the agreement will not exceed the amounts paid by you to Bright On Analytics Ltd dba Trampolin.ai or Insights for the services giving rise to the claim during the twelve (12) months before the first event giving rise to liability.
This Section is subject to Section 11(e)–(g) and applies to the fullest extent permitted by law.
You will defend, indemnify, and hold harmless Trampolin.ai and its affiliates, officers, directors, employees, and agents from and against third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services in violation of the Agreement or law; (b) Customer Content; or (c) your infringement or misappropriation of third-party rights.
We may suspend or terminate your access if you breach the Agreement, pose a security risk, fail to pay, or if required by law. You may terminate by closing your account and ceasing use. Sections intended to survive (including 11–15, 18–22) do so.
There are no third-party beneficiaries to the Agreement.
You are responsible for compliance with all laws applicable to your use of the Services and Customer Content.
These Terms are governed by the laws of the Hong Kong Special Administrative Region (HKSAR), without regard to conflict-of-laws rules. The courts of Hong Kong SAR have exclusive jurisdiction over disputes arising out of or relating to these Terms, subject to any non-waivable consumer protections.
We may provide notices via the Services, in-app, email, or your account contact details. Notices to Bright on Analytics Ltd dba Trampolin.ai or Insights must be sent to [email protected]. Notices are deemed given when received (or when posted within the Services, where applicable).
We will not be liable for delay or failure to perform due to events beyond our reasonable control, including third-party platform/API changes or outages; internet, CDN, cloud, or data-center issues; power failures; labor disputes; acts of God; war; terrorism; government actions; pandemics/epidemics; or other force-majeure events. Performance is excused for the duration and to the extent of the event.

If any provision is unenforceable, the remainder remains in effect.
You may not assign without our prior written consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.
These Terms and documents incorporated by reference constitute the entire agreement and supersede prior or contemporaneous communications.
